The stated General Terms and Conditions (hereinafter T&C) contain the conditions for the use of the service available on the website www.goncshop.com (hereinafter: Website) by the user (hereinafter: User or Customer).

The handling of the user's personal data is provided for in the Privacy Policy, which can be accessed directly from the main page or through the following link.

The technical information required for the use of the Website, which is not contained in the T&C, is provided by the information available on the Website.

The language of the contract is Hungarian, that is translated into English.

The contract is not considered a written contract, they are not filed by goncshop.com, so it cannot be accessed or viewed afterwards.

goncshop.com is not subject to the provisions of any code of conduct.

2.1. Responsibility

The User may use the Website solely at his/her own risk and accepts that goncshop.com shall not be liable for material or non-material damage arising during use, in addition to liability for breach of contract that causes damage to human life, physical integrity or health.

goncshop.com disclaims all responsibility for the behavior of website users. The User is obliged to ensure that, when using the Website, he/she does not directly or indirectly violate the rights of third parties or the law. The user is fully and exclusively responsible for his/her own behavior, in such cases goncshop.com fully cooperates with the acting authorities in order to detect violations.

goncshop.com is entitled, but not obliged, to check the content that may be made available by the Users while using the Website, and goncshop.com is entitled, but not obliged, to look for signs of illegal activity in relation to the published content.

The pages of the service may contain connection points (links) that lead to the pages of other service providers. goncshop.com is not responsible for the data protection practices and other activities of these service providers.

Due to the global nature of the Internet, the User accepts that the provisions of the relevant national legislation are taken into account when using the Website. If any activity related to the use of the Website is not permitted according to the law of the User's country, the User is solely responsible for the use.

If the User notices objectionable content on the Website, he/she must report it to goncshop.com immediately. If, during goncshop.com's good faith procedure, the indication is found to be justified, it has the right to immediately delete or modify the information.

The agreement between goncshop.com and the User based on these General Terms and Conditions shall be terminated if the User cancels his/her registration or if goncshop.com cancels the User's registration.

  1. Shopping in the online store

A significant part of the content of the Website is available to all Users without registration. Some services require registration (and then login).

The user can register after clicking on the "Registration" menu item on the Website's interface or when placing the first order, where the following data must be provided to goncshop.com:

goncshop.com informs the User about the success of the registration by e-mail.

In the case of placing an order, the registered User only needs to log in to the created registration account by entering the e-mail address and password and does not have to enter his data again and again during the order.

The user has the right to cancel his/her registration at any time by logging into his/her user account in the delete user account menu with the "DELETE MY ACCOUNT" button or by sending a message to the e-mail address goncbolt@gmail.com. After receiving the message, goncshop.com is obliged to cancel the registration immediately. The user's data will be removed from the system immediately after deletion; however, this does not affect the preservation of data and documents related to orders already placed, and does not result in the deletion of this data. After removal, there is no way to restore the data.

The User is solely responsible for keeping user access data (especially the password) confidential. If the User learns that an unauthorized third party may have gained access to the password provided during registration, he/she must immediately change his/her password, and if it can be assumed that the third party is abusing the password in any way, he/she must notify goncshop.com immediately.

The User undertakes to update the personal data provided during registration as necessary in order to ensure that they are timely, complete and in accordance with reality.

3.1.Selection of product

The customer has the opportunity to choose or order from the store's products. By clicking on the selected product, the customer can view its detailed description. If you intend to buy, you place the product you want to buy in a virtual basket by pressing the "Add to Cart" button. By clicking on the "View" button of the basket, you will find the products placed in the basket during the purchase, as well as the total amount of the invoice and the shipping cost. Here you can check the correctness of your order, especially with regard to prices and quantities. The cart automatically calculates the total amount of the order.

3.2. Sending the order

If you think the amount of products in the basket are adequate, you have checked the total and you have decided that you want to buy them, then simply click on the "Checkout" button. In our store, you can also shop without registration, so you can choose from three options:

  • would you like to log in as an already registered customer
  • you want to register as a new customer
  • maybe you want to buy without registration

If you have already made a purchase in our store, please enter the e-mail address and password you entered during the previous registration. If you want to register as a new customer, enter the data required for the purchase, which will be stored by the system, and you only have to log in the next time you make a purchase. For purchases without registration, enter your billing and shipping address.
In the next step, choose the shipping method that suits you:

After that, you must choose a payment method that suits you:

  • bank card (Simple Pay by OTP)
  • Paypal

If you agree with the content of the order, click the "Place order" button to send the order.

3.3. Discounts, coupons

Coupons provide discounts that can reduce the amount of the purchase. Coupons can be obtained through various promotions. When using the coupons, the coupon code must be entered in the small empty field below the contents of the basket, then by clicking on the "REDEEM COUPON" button, the value of the coupon will be automatically deducted from the total amount. The voucher cannot be exchanged for cash, partial payment is not possible.

3.4. Correction of data entry errors

At any stage of the order and until the order is sent to goncshop.com, the User has the opportunity to correct data entry errors at any time on the Website interface, either in his own account (modification of user data) or on the order interface (e.g. deleting a product from the basket by clicking on the red X icon by clicking). Data entry errors include, for example, an incorrectly entered quantity that can be changed with the (+,- keys), placing the wrong product in the cart and then deleting the product from the cart, misspelling order data, etc. (e.g. delivery address).

3.5. Binding offer, confirmation

goncshop.com will confirm the reception of the offer sent by the User by e-mail without delay, but must do so within 72 hours at the latest, with a confirmation e-mail that contains the data provided by the User during the purchase or registration (billing and delivery information ), the order identifier, the date of the order, the list of elements belonging to the ordered product, the quantity, the price of the product, the shipping cost and the total amount to be paid.

This confirmation e-mail on the part of goncshop.com is considered acceptance of the offer made by the User, which creates a valid contract between goncshop.com and the User.

The user is exempted from being bound by the offer if he does not receive the confirmation e-mail regarding the order sent by goncshop.com within 72 hours.

If the User's order has already been sent to goncshop.com and you notice an error in the data in the confirmation e-mail, you must report it to goncshop.com within 1 day, in order to avoid the fulfillment of unwanted orders.

The order is considered a contract concluded electronically, which is governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commercial services and services related to the information society. are governed by the law. The contract falls under the scope of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between the consumer and the business, and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

3.6. Prices

Our prices are list prices valid at the time of the order, which can be found next to the products in the online store. Our prices are gross prices, but these prices do not include shipping costs. You can find out about the exact amount of the shipping cost during the checkout process before finalizing the order. If there is an error or deficiency in the products or prices in the online store, we reserve the right to correct them. In such a case, we inform the customer of the new data immediately after the error is recognized or modified. The customer can then confirm the order once more, or it is possible for either party to withdraw from the contract.

3.7. Processing orders
Orders are processed within three business days.

3.8. Possibility to correct data entry errors
You have the opportunity to correct data entry errors before pressing the "Place order" button.

3.9. Confirmation
We send e-mail feedback on all orders. This means that after placing the order, you will receive an automatic e-mail about the receipt of the order and (later) one about the expected delivery time. In the case of a phone consultation, call customer service or any of the phone numbers in the e-mail.

3.10. Payment Terms
In our store, it is possible to place and order by purchase with bank card or Paypal.

3.11. Delivery

Package delivery can be requested for home delivery. Shipments are delivered and transported by GLS Hungary Kft. courier service. The online store explains the expected delivery date and time of the product(s) in an additional e-mail following order confirmation e-mail.

The courier service provider delivers orders from Monday to Friday, between 08:00 and 17:00. If the User is not present at the specified address during this period, it is advisable to enter a delivery address where the User can certainly receive the ordered product during the delivery period.

If the User is not at the delivery address specified during the order, the courier service will try the delivery again on the next working day.

Upon reception of the product from the person carrying out the delivery and by signing the document confirming the receipt, the quantity and quality of the product is accepted, which means that goncshop.com cannot accept quantity and quality complaints after the courier has left. By signing the delivery note, you therefore acknowledge that the received package conforms both externally and in terms of its contents to the contents of your order (the contents of the package are not incomplete, the packaging or the product is not damaged).

If the User notices damage to the product or the packaging, a record of the damage must be made in the presence of the person making the delivery during the delivery. If the packaging or the product is visibly damaged upon receipt, and the damage occurred before the receipt of the goods, goncshop.com will take back the product free of charge. goncshop.com assumes no responsibility for damage detected after receipt!

3.11.2. Delivery time

From December 15 to December 27, the expected delivery time will be changed to 2-10 working days due to the holidays.

Expected delivery time: 2-5 working days. It is very important that, in the absence of a different agreement, goncshop.com must provide (deliver) the product to the consumer without delay, but no later than thirty days after the conclusion of the contract.

In the event of a delay on the part of goncshop.com, the User who is considered a consumer is entitled to set an additional deadline. If goncshop.com does not perform within the additional deadline, the consumer has the right to withdraw from the contract.

The consumer is entitled to withdraw from the contract without setting an additional deadline if

  1. a) goncshop.com refused to fulfill the contract; or
  2. b) according to the agreement of the parties or due to the recognizable purpose of the service, the contract should have been performed at the specified performance time - and not at any other time.

3.12. Shipping fees:
Our delivery fees depend on destination of packages. Shipping is calculated once items are placed in the cart, at checkout, before placement of order.

3.13. Invoice

When the ordered products are delivered, goncshop.com sends the User an electronic invoice to the specified email address as proof of payment.

3.14. Cancellation of delivery
If the online store does not fulfill its obligations under the contract because the goods specified in the contract are not available, or because it is unable to provide the ordered service, it is obliged to inform the customer of this. The online store does not enter into contracts with minors. By accepting the terms and conditions, the customer declares that he/she is of legal age.

  1. Refund and return

Az e pontban foglaltak kizárólag a szakmája, önálló foglalkozása vagy üzleti tevékenysége körén kívül eljáró természetes személyre vonatkoznak, aki árut vesz, rendel, kap, használ, igénybe vesz, valamint az áruval kapcsolatos kereskedelmi kommunikáció, ajánlat címzettje (a továbbiakban „Fogyasztó”).

The provisions of this point apply only to natural persons acting outside the scope of their profession, independently of their occupation or business, who buy, order, receive, use, as well as receive commercial communications and offers related to the goods (hereinafter referred to as "Consumer").

4.1. The consumer is entitled in the case of a contract for the sale of the product

  1. a) the product,
  2. b) when being provided several products, to the last product provided,

the consumer or a third party other than the carrier indicated, is allowed withdraw from the contract without having to give reason within fourteen (14) days from the date reception of order.

If the Consumer wishes to exercise his/her right of withdrawal, he/she must send a clear statement containing his/her intention to withdraw (by post or via a letter sent electronically) to goncshop.com using the contact details indicated in point 1 of the Terms of Service. For this purpose, the Consumer can state  their will to withdraw by completing the Return Form received with all orders, that is also available for download at the following link.

The consumer has the right to exercise his right of withdrawal in the period between the date of conclusion of the contract and the day of reception of the product(s).

The consumer exercises his/her right of withdrawal within the deadline if he/she sends his/her withdrawal statement to goncshop.com before the deadline indicated above.

In both cases, goncshop.com will immediately confirm reception of the Consumer's withdrawal statement by email.

In case of withdrawal stated in writing, it shall be considered valid if the Consumer sends his/her declaration to this effect within 14 calendar days (even on the 14th calendar day) to goncshop.com.

When notifying by mail, goncshop.com takes into account the date of mailing, and in the case of notification by e-mail, the time the e-mail was sent, in terms of calculating the deadline. If the Consumer sends the letter as registered mail, the date of posting can be reliably proven.

In the event of withdrawal, the consumer must return the ordered product(s) to the indicated address of Gönc Luxury Vintage (Szalsza Kft.), 1088 Budapest, Múzeum utca 9, Hungary. The deadline is considered to have been met if the Consumer sends the product before the 14-day deadline (posts it or hands it over to chosen courier).

When returning the product - if the product is not returned by the Consumer in its original packaging - it must be carefully packaged so that it does not get damaged.

The direct cost of returning the product(s) to the address of Szalsza Kft. is borne by the Consumer. Goncshop.com is unable to accept packages returned by cash on delivery or left at the post office. Apart from the direct cost of returning the product(s), the Consumer will not be charged any other costs in connection with the cancellation.

If the Consumer withdraws from the contract, goncshop.com will immediately, but no later than within 14 days from the reception of the Consumer's withdrawal statement ("Return Form"), refund all the compensation provided by the Consumer, except for the additional costs incurred due to the Consumer having chosen an alternative transportation method to the cheapest one offered by goncshop.com. goncshop.com has the right to withhold the refund until the product has been returned, or the Consumer has provided credible evidence that he/she has returned it: of the two, goncshop.com will consider the earlier date.

The Consumer can only be held responsible for the decrease in value of the product if it occurred due to use exceeding the use necessary to determine the nature, properties and operation of the product.

The Consumer does not have the right of withdrawal if he/she returns the product without the label and/or packaging(dustbag, authenticity papers, original brand box, etc.) of on the product.

  1. WARRANTY

In the case of a consumer contract, until the contrary is proven, it must be assumed that the defect recognized by the consumer already existed at the time of the performance within six months of the performance, unless this presumption is incompatible with the nature of the matter or the nature of the defect. In the first six months, therefore, goncshop.com must prove that the thing sold to the consumer met the quality requirements established in the contract or legislation at the time of delivery. However, after six months, the consumer must prove that the product was defective.

5.1. Accessories warranty

In the event of faulty performance by goncshop.com, the user can enforce a warranty claim against goncshop.com. In the case of a consumer contract, the User can enforce his/her warranty claims for product defects that already existed at the time of delivery of the product within a 2-year statute of limitations from the date of receipt. After the two-year limitation period, the User can no longer assert his/her accessory warranty rights.

In the case of a contract concluded with a non-consumer, the entitled party may enforce his warranty claims within a 1-year limitation period from the date of receipt.

The User may - at his or her choice - request a repair or replacement, unless fulfilling the User's chosen request is impossible or would involve disproportionate additional costs for goncshop.com compared to the fulfillment of another request. If the repair or replacement was not requested or could not be requested by the User, the User may request a proportionate delivery of the compensation or the User may correct the defect at goncshop.com's expense, or have it corrected by someone else or - as a last resort - withdraw from the contract. There is no room for cancellation due to an insignificant error.

The user can switch from the chosen accessory warranty right to another, but he/she is obliged to bear the cost of the switch, unless it was justified or given by goncshop.com.

The User is obliged to report the error to goncshop.com immediately after its discovery, but no later than within two months from the discovery of the error.

The User can assert his/her accessory warranty claim directly against goncshop.com.

Within six months from the completion of the contract, there is no other condition for asserting the accessory warranty claim other than reporting the defect, if the User proves that the product was purchased from goncshop.com (by presenting an invoice or a copy of the invoice). In such a case, goncshop.com will only be released from the warranty if it refutes this presumption, i.e. it proves that the defect of the product occurred after it was handed over to the User. If goncshop.com can prove that the cause of the error was caused by a cause that can be blamed on the User, it is not obliged to accept the warranty claim made by the User. However, after six months have passed since the performance, the User is obliged to prove that the error recognized by the User was already present at the time of performance.

If the User asserts his/her warranty claim with respect to a part of the product that is separable from the point of view of the indicated defect, the warranty claim is not considered asserted for other parts of the product.

5.2. Product warranty

In the event of a defect in the product (movable thing), the Buyer who is considered a consumer - according to his/her choice - can assert a right or a product warranty claim specified in point 5.1.

However, the User does not have the right to assert an accessory warranty claim and a product warranty claim at the same time, parallel to each other, due to the same defect. However, in the case of successful enforcement of a product warranty claim, the User may assert his/her accessory warranty claim for the replaced product or repaired part against the manufacturer.

As a product warranty claim, the User can only request the repair or replacement of the defective product, i.e. there is no possibility of monetary remedy, price reduction or cancellation, since no contractual relationship has been established between the manufacturer and the consumer, there is no contract. The User must prove the defect of the product in the event of a product warranty claim.

A product is considered defective if it does not meet the quality requirements in force at the time it is placed on the market or if it does not have the properties described by the manufacturer.

The User may assert a product warranty claim within two years of the product being placed on the market by the manufacturer. After this deadline, you will lose this right. After discovering the error, the User is obliged to notify the manufacturer of the error without delay. An error communicated within two months of the discovery of the error must be considered communicated without delay. The consumer is responsible for damage resulting from the delay in communication.

The user can exercise his/her product warranty claim against the manufacturer or distributor of the movable item (goncshop.com).

The manufacturer, distributor (goncshop.com) is only released from its product warranty obligation if it can prove that:

- the product was not manufactured or marketed as part of its business activities, or
- according to the state of science and technology, the defect was not recognizable at the time of placing it on the market or
- the defect of the product results from the application of legislation or mandatory official regulations.

It is sufficient for the manufacturer or distributor (goncshop.com) to prove one reason for exemption.

5.3. Warranty

The mandatory warranty for certain durable consumer goods regarding the mandatory warranty for certain durable consumer goods based on 151/2003 (IX. 22.) Government decree contains regulations. The (objective) scope of the decree only applies to the products sold within the framework of the new consumer contract concluded in Hungary and listed in the annex to the decree.

For the durable consumer goods listed in the annex to the government decree, the mandatory warranty is 1 year, the starting date of which is the day the product is handed over to the Consumer or, if the installation is carried out by goncshop.com or its agent, the day of installation. goncshop.com validates the warranty card attached to the product when the User receives the product.

In case of warranty, the User has the same rights as in 5.1. are indicated in the section on accessory warranty.

The company is exempted from warranty obligations only if it proves that the cause of the defect arose after performance.

However, the User does not have the right to assert an accessory warranty and warranty claim, or a product warranty and warranty claim at the same time, parallel to each other, due to the same defect. Regardless of these limitations, the User has the rights arising from the warranty in regardless of the rights defined in point 5.1 and 5.2.

The defect is not covered by the warranty if its cause occurred after the product was handed over to the Consumer, for example, if the defect

- unprofessional commissioning (unless the commissioning was carried out by goncshop.com or its agent, or if the unprofessional commissioning can be traced back to an error in the user and management instructions),
- improper use, disregarding the instructions for use and management,
- improper storage, improper handling, damage,
- elemental damage, caused by a natural disaster.

The consumer can switch from the chosen right to another. The costs caused by the transfer must be paid to goncshop.com, unless the Service Provider gave a reason for the transfer, or the transfer was otherwise justified.

In case of doubt, goncshop.com will have the product inspected by an expert. The purpose of the investigation is to prove that the product was defective as a consequence of whose blameworthy behavior. If it is proven that the cause of the error is the result of improper use, goncshop.com is not obliged to fulfill the warranty claim.

If the Consumer asserts a replacement request within three working days from the date of purchase (commissioning) due to product failure, goncshop.com cannot claim disproportionate additional costs, but is obliged to replace the product, provided that the failure prevents the intended use.

The repair or replacement must be carried out within an appropriate time frame, taking into account the characteristics of the product and the purpose expected by the Consumer, while protecting the interests of the Consumer. goncshop.com shall endeavor to carry out the repair or replacement within a maximum of fifteen days.

During the repair, only new parts may be installed in the product.

The part of the repair time during which the Consumer cannot use the product as intended is not included in the warranty period. In case of replacement (repair) of the product or part of the product, the warranty period starts again for the replaced (repaired) product (product part) and for the defect that occurs as a result of the repair.

goncshop.com shall bear the costs related to the fulfillment of the warranty obligation.

The warranty does not affect the enforcement of the Consumer's rights arising from the law, especially those related to accessories and product warranties or compensation.

In the event of a consumer dispute, the Consumer may also initiate the procedure of the conciliation board operating alongside the county chambers of commerce and industry.

The warranty claim can be asserted directly with the warranty ticket and at the service indicated on it. In the event that a warranty certificate is not provided to the Consumer, the conclusion of the contract shall be considered proven if the Consumer presents the receipt confirming the payment of the consideration - an invoice or receipt issued on the basis of the General Sales Tax Act. In this case, the rights arising from the warranty can be asserted with a receipt confirming the payment of the consideration.

5.4. Validation of warranty claims

The User can enforce his/her warranty and guarantee requirements:

  1. ENFORCEMENT OPTIONS

6.1.Place, time and method of handling complaints

The User can submit consumer objections related to the product or the activities of goncshop.com through the following contacts:

If possible, goncshop.com will remedy the verbal complaint immediately. If it is not possible to remedy the verbal complaint immediately, due to the nature of the complaint, or if the User does not agree with the handling of the complaint, then goncshop.com will keep a record of the complaint - which will be kept for five years, together with the substantive response to the complaint.

goncshop.com is obliged to hand over a copy of the protocol to the User on the spot in case of a verbal complaint made in person, or if this is not possible, it must act according to the rules for written complaints detailed below;

In the case of a verbal complaint communicated using other electronic communication services, goncshop.com will send a copy of the protocol to the User at the latest at the same time as the substantive response.

In all other cases, goncshop.com acts according to the rules for written complaints.

6.2. Other Remedies

The European Commission has created a website where consumers can register, so they have the opportunity to settle their legal disputes related to online purchases by filling out an application, avoiding court proceedings. In this way, consumers can assert their rights without, for example, distance preventing them from doing so. If you want to make a complaint about a product or service you bought online and you don't necessarily want to go to court, you can use the online dispute resolution tool. On the portal, you and the merchant against whom you have filed a complaint can jointly select the dispute resolution body you want to entrust with handling the complaint. In the application of the rules applicable to the Conciliation Board, a consumer is also a non-governmental organization, church, apartment building, housing association, micro, small and medium-sized enterprise under a separate law who buys, orders, receives, uses, makes use of goods, or commercial communications or offers related to the goods addressee.

  1. UNILATERAL AMENDMENT OF THE GENERAL CONTRACT TERMS

goncshop.com has the right to unilaterally modify these General Terms and Conditions, in addition to informing the Users in advance on the Website. The modified provisions become effective against the User upon the first use of the Website after they come into effect, and they must be applied to orders placed after the modification.

  1. RETENTION OF OWNERSHIP

 

The product remains the property of goncshop.com until full payment of the purchase price. If, for any reason, the product still comes into the possession of the User before full payment of the purchase price, he/she is liable to goncshop.com for all damages for which no one can be obliged to compensate.
